Major Developments in Jane Doe (Suicide Attempt) Lawsuit Against RI Department of Education
There have been two major developments in the Jane Doe case against the RI Department of Education (RIDE), where the plaintiff suffered a parental rights nightmare that resulted in a 2024 suicide attempt by her daughter.
Two related complaints have been filed by the Law Centre at the RI Center for Freedom & Prosperity against RIDE and its Commissioner, Angelica Infante-Green.
The Superior Court complaint seeks repeal of RIDE’s 2017 regulation, adopted by the Council on Elementary and Secondary Education – a mandate that by July 1, 2018, each local education agency (LEA) must implement policies protecting transgender and gender non-conforming students. (More details here)
The first development is indicative of the importance of this case to the woke Left, which became clearly evident after a lawyer representing the ACLU of RI added her name as a “contact” for the Superior Court case in order to receive “notification of service” as the case develops. With the ACLU now actively monitoring the case, it is a tacit admission of the threat Jane Doe’s case poses to RIDE’s overall transgender guidance and which could dramatically alter the course of the pro-transgender K-12 policies in our state. Oral arguments are scheduled for August 19, 2025.
Since 2016, the ACLU has overtly promoted the concept of special rights and protections for K-12 transgender students, even though no such rights are directly or indirectly embodied in the US or RI Constitution … and even thought the granting of such protections may cause infringements on the rights of others.
The legal concept of special rights for special interest groups – especially when at the expense of others – is clearly in play in this case … and why the ACLU appears to have interest in preserving its identity politics positions.
Secondly, Doe won a significant victory for herself and the larger parental rights movement in the second complaint filed against RIDE. This internally adjudicated complaint alleges that the public school district of Doe’s daughter had not turned over all school and medical records as required by law, as requested by the Law Centre, and as authorized by the mother, Jane Doe.
Initially, the school district released only standard grade and attendance records, denying there were any further documents related to the “transition” of Doe’s daughter.
However, after an initial conference between the attorneys for Doe (Gregory Piccirilli), the school district, and RIDE with the hearing officer, the school district backed down and admitted there were indeed additional records. These were subsequently turned over to Doe … but only after threat of a subpoena.
The records were comprised of emails which confirm that school district officials aided the minor girl in her wish to transition to a boy, without any questions or counseling. According to the 5 emails released, a clearer timeline can be established:
- In September 2022, the school district referred to the daughter as “they“, indicating that daughter Doe had previously requested a change in her pronouns. (No school official notified mother Jane Doe)
- In October 2022, the daughter emailed a request for her name to be changed to a Russian spelling of a boy’s name in Aspen, the school district’s student management database system. (No school official notified mother Jane Doe)
- (NOTE: In April 2024, daughter Doe attempted suicide at home in front of her mother and sibling, according to Jane Doe. See the full emotional interview, here.)
- In October 2024, daughter Doe again asked for her name to be changed in Aspen. The redacted email does not indicate to whom the request was made, but the response stated that the Principal is the only person who can make the change in Aspen, potentially explaining why her 2022 request was not granted.
- That same day, the daughter apparently emailed the Principal (name redacted) asking for her “preferred” name to be changed in Aspen, with the Principal responding that a help desk ticket would be put in “right now”. (No questions asked.)
- Finally, in early November 2024, daughter Doe received an email notifying her that her preferred name “has been updated on your details page.” (No school official notified mother Jane Doe)
RIDE has also been referred for investigation to the Office of Civil Rights (OCR) at the US Department of Education by the Law Centre. It is expected that the newly installed OCR will soon respond.
